Terms of Service

FaFan (“FaFan”, “we”, “us”) operates fa.fan, a platform that lets creators build a store and sell digital products, memberships, bookings and more (the “Services”). By accessing or using the Services, you agree to these Terms of Service. If you do not agree, do not use the Services.

• Creator — a user who sets up a store and offers products through the Services.
• Buyer — a person who purchases a product through a creator’s store.
• Content — anything uploaded or sold through the Services, including text, images, files and products.

You must be at least 18 years old, or the age of majority where you live, to use the Services. You are responsible for the activity under your account and for keeping your sign-in secure. Please provide accurate information and keep it up to date.

For purchases made through creator stores, FaFan acts as the Merchant of Record. This means FaFan (through its payment partners) sells the product to the buyer, collects payment, and is responsible for handling applicable sales taxes. The creator authorises FaFan to sell their products on their behalf, and FaFan remits the creator’s share as a payout.

As a result, the buyer’s purchase contract for the transaction is with FaFan, while the underlying product and its fulfilment are provided by the creator.

You retain ownership of your Content. You grant FaFan a worldwide, non-exclusive licence to host, display, market and sell your Content through the Services for the purpose of operating your store and completing sales.

You are responsible for your products, including their descriptions, delivery and that you have the rights to sell them. You may not sell or upload Content that:

• is illegal, infringing or fraudulent;
• violates someone else’s intellectual property or privacy;
• is sexually explicit, hateful, or promotes violence; or
• otherwise violates these Terms or applicable law.

Fees for using the Services are described at sign-up and on our pricing page. Payment-processing fees may also apply. We remit creator earnings to your chosen payout method (such as PromptPay) on the applicable schedule, after deducting fees and any refunds or chargebacks.

Creators are responsible for their own income taxes. As Merchant of Record, FaFan may collect and remit sales tax or VAT where required.

When you buy through a store, you purchase the product as described. Digital products are delivered electronically. Because many products are digital and delivered immediately, sales may be final except where required by law or where a refund is offered.

If something is wrong with your purchase, contact support@fa.fan and we will work with you and the creator to resolve it.

You agree not to misuse the Services, including by attempting to break security, scrape data, circumvent fees, or use the Services for any unlawful purpose.

The FaFan name, logo and the Services are owned by FaFan. Content uploaded or sold through the Services remains owned by the respective creator or rights holder.

The Services rely on third parties such as Google and Stripe. Your use of those features may also be subject to their terms.

The Services are provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not guarantee that the Services will be uninterrupted or error-free.

To the maximum extent permitted by law, FaFan will not be liable for indirect, incidental or consequential damages, or for lost profits or revenue, arising from your use of the Services.

We may suspend or terminate access to the Services if you violate these Terms or use the Services in a way that may cause harm or legal liability. You may stop using the Services at any time.

These Terms are governed by the laws of Thailand, and any disputes will be subject to the courts of Thailand, unless otherwise required by applicable law.

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Services means you accept the updated Terms.
